Please read these Terms of Use carefully before using this website. By accessing or using nursinghomeviolations.com (the "Site"), you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Nature of the Site

The Site aggregates and reorganizes information drawn from datasets the Centers for Medicare & Medicaid Services ("CMS") publishes as public record. The Site is an information resource and attorney-advertising service operated by the Site's owner. It is not a law firm. It does not provide legal services. It does not create an attorney–client relationship between you and the Site or its operators.

2. No legal, medical, or professional advice

Information on the Site is general in nature and is not a substitute for advice from a licensed attorney, physician, or other qualified professional. Do not act or refrain from acting based on anything you read here without first consulting the appropriate professional.

3. No attorney–client relationship

Submitting a contact form or otherwise communicating with the Site does not create an attorney–client relationship. Communications submitted through this Site may be shared with one or more participating plaintiff attorneys in the Site's network. Those attorneys will decide independently whether to accept your matter. An attorney–client relationship is formed only when you and an attorney have entered into a written engagement agreement.

4. No guarantee of accuracy

Information on the Site is provided "as is" and "as available." While the Site aims to faithfully reproduce the current public CMS record, data may contain errors, omissions, or out-of-date entries. CMS publishes quarterly, so there is a natural lag between events at a facility and their appearance here. Citations shown on the Site are findings by state survey teams working under federal contract — they are not court judgments and may be subject to federal Informal Dispute Resolution. The Site makes no warranty, express or implied, regarding the accuracy, completeness, or timeliness of any information.

5. No endorsement

Listing a facility on the Site is not a recommendation for or against that facility. Listing a plaintiff attorney in the Site's network is not a recommendation or endorsement of that attorney. Inclusion reflects either participation in the Site's lead-referral service or the presence of the facility in the CMS public dataset.

6. Your use of the Site

You agree not to: (a) use the Site in a way that violates any law; (b) attempt to reverse-engineer, scrape, or overload the Site; (c) use the Site to harass, defame, or threaten any person or facility; (d) post content to any form or endpoint that is unlawful, defamatory, or infringing. You are responsible for the accuracy of information you submit.

7. Intellectual property

The underlying citation and penalty data is federal public record and is not owned by the Site. The presentation, copy, design, and search tools on the Site are the work of the Site's operators. You may link to pages on the Site freely. You may not copy substantial portions of the Site's presentation or design without written permission.

8. Limitation of liability

To the maximum extent permitted by law, the Site, its operators, and any participating attorneys shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Site. The Site's total liability for any claim arising from your use of the Site shall not exceed one hundred dollars (US$100).

9. Indemnification

You agree to indemnify and hold harmless the Site, its operators, and its affiliates from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms or your use of the Site in violation of any law.

10. Changes to these Terms

The Site may update these Terms at any time. The "Last updated" date at the top reflects the most recent change. Continued use of the Site after a change constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in California.
